Treaty Land Entitlement Replacement Contracts
Indian Oil and Gas Canada (IOGC) issues and administers replacement contracts that replace provincial and freehold oil and gas agreements on lands sought to be added to reserve. These IOGC replacement contracts are authorized under various federal legislation. Agreements to be replaced include all oil and gas subsurface and surface-related agreements in existence at the time the lands are selected for Treaty Land Entitlement (TLE) purposes. These standardized contracts ensure that previously-held third party oil and gas interests are continued when the lands gain reserve status.
Process
IOGC initiates the processing of replacement contracts once the following documentation has been received:
- A copy of the agreement to be replaced;
- A Provincial search;
- A legible survey plan (if applicable);
- Surrender documentation from the Provincial Crown Authority;
- Lessee contact name and telephone number; and
- A letter confirming that the existing lessee has agreed to have the lands transferred to a new lessor in the TLE replacement process (subsurface only).
New Dispositions
If the TLE lands have already been granted reserve status and designated for oil and gas development, then IOGC issues new subsurface and surface contracts under the Indian Oil and Gas Regulations, (SOR/2019-196).
If the TLE lands have not yet been granted reserve status but have been pre-designated for oil and gas development, then IOGC issues new subsurface and surface contracts under the applicable federal legislation, which requires approval of a quorum of the First Nation's council and approval of the Executive Director of IOGC. Moneys paid to IOGC for these contracts remain in an interest-bearing suspense account until reserve creation.
